School District #23  requires that  a CUSTODIAN EVALUATION must be:
1. Completed ten (10) days prior to the end of probation. (Buckley failed to do so)
2. Shown to the employee. (Buckley deceitfully hid them from Fisher)
3. Signed by all parties. (Buckley failed to give Fisher a chance to sign them)
4. Forwarded to the Human Resources Department of School District #23.
Principal Buckley ignored those SD #23 requirements.
She hid the evaluations from Custodian Fisher, who was never shown them for discussion and signing as required by SD #23. Buckley was out to get Fisher fired at all cost, she was not about to allow Fisher the opportunity as SD #23 required. No Buckley was not into fairness. Meanwhile SD #23 turned a blind eye. Buckley operated a double standard, everyone but her had to obey the rules.

Through the British Columbia Freedom Of Information Commissioner, Fisher was able to uncover two evaluations deceitfully hidden from him by Buckley, both for the same time period and each filled in differently.

with error and inconsistency with the sole intention of depriving Fisher of employment.
Rubadeau, Akehurst, Lownsbrough, Buckley & Lalonde conspired to defraud Fisher of
money, regular employee status, employee rights & health benefits.
Rubadeau, Akehurst, Lownsbrough, Buckley & Lalonde's conduct toward Custodian Fisher can be described as harsh, vindictive, malicious & reprehensible and called it a substantial departure from the conduct and practices to be reasonably expected from
School District #23 Administrators.

4. Blocking the victim's leave for promotion to regular employee status.
5. Assigning unreasonable duties to the victim already working an oversize area.
6. Constantly & persistently criticizing the victim's work.
7. Making false accusations about the victim knowing them to be wrong.
(There was no evidence found, that Buckley had met the requirement to forward the evaluations to the Human Resources Department nor that School District #23 questioned her failure to follow procedure. Under Rubadeau SD #23 lacks the necessary system checks & balances found in a competent administration)
At a time when there is concern about schoolyard bullying, Buckley, Lalonde & Stutter got away with workplace bullying Custodian Fisher
Principal Buckley submitted unwarranted and undeserving
Custodian Evaluations replete with error and inconsistency
with the sole intention of depriving Fisher of employment.

it intended to rely on, for the performance evaluation was accurate.

evaluation itself as objectively & fairly as possible!

School District #23 did not have the right to add 52 additional days to Fisher's probation nor fire him on Feb 25 / 99 for general unsuitability since Fisher had served the required 65 days of probation & legally earned regular employee status with benefits on July 24, 1998 preventing dismissal on grounds of general unsuitability.

Following are examples of what experts refer to as psychological violence in the workplace that takes the form of bullying, intimidation & harassment.

Principal Buckley used distortion to have 52 days added to Fisher's probation period.

Principal Buckley often shortened Custodian Fisher's shift, then assigned extra work.

Vice Principal Lalonde told lies about Fisher to SD #23 administration.

Head Custodian Stutter constantly unjustifiably criticized Fisher.

Head Custodian Stutter constantly threatened Fisher with a bad report.

Head Custodian Stutter told lies about Fisher to Principal Buckley.

Head Custodian Stutter lied about ordering desperately needed supplies & equipment.

SD 23 was “malicious, high-handed, outrageous, reckless, wanton, entirely without
care, intentional, deliberate, callous, disgraceful, willful, exploitative, and in disregard
of Custodian Fisher's rights and indifferent to the consequences.”

On this Principal Buckley first checked off No then changed it to NI needs improvement. Truth is Ken was better trained than the Head Custodian & Ken's cleaning was superior to the Head Custodian's work. Below are Ken's Duties to Do Lists that he carried & check each item off as it was completed each night.

Truth is Ken had an excellent relationship with the Teachers in the area that he cleaned & with all night use groups..see below a thank you card from a teacher in appreciation for finding her ear ring & for getting her extra rolls of paper towels. Principal Buckley on the other hand never thanked Ken for finding  & bringing to her a fake hypodermic needle. She harboured ill feelings towards Ken ever since he suggested that the proper thing for her to do was to go though the Head Custodian rather than go through Ken regarding the custodian room in the portables.
