April 21/99 meeting Fisher had with Al Akehurst, Director of Human Resources, "We're not talking about your ability to be a custodian, in the sense of your ability to do your duties, do the physical work of a custodian. Cause that's not the reason."..."The way it's described to me and the way I (Akehurst) understood it, is nobody was objecting to the way you were doing the cleaning itself".
This is contrary to Lownsbrough in the Feb 25/99 letter (which was written by Buckley) in which they stated that Fisher's performance was less than satisfactory. Fisher however was an excellent custodian.
Fisher Apr 9/99 letter to Akehurst, Fisher responding to Buckley's allegations that he had left 1 hour and 45 minutes early on Nov 20/98, "On Nov 20/98 I continued to work waxing the hall floors until 12:30 or 1:00 AM. The alarm data proves it to be true that I worked until 12:56 AM." (24:56AM).
Buckley wrote in the border of a copy of Fisher's Apr 9/99 letter that Akehurst sent to her, "The report shows this to be true, how did he (Fisher) know he worked till exactly 12:56?".
This illustrates that Buckley failed to decipher the letter contents clearly, as the answer to her question of how Fisher knew exactly 12:56 was there in the sentence, the alarm data printout showed the 12:56.
Fisher is reminded of his comment in a Nov 19/98 meeting when he stated that, Buckley's version of events were distorted and Fisher's were more accurate. Buckley at the time said, " Fisher's statement was insubordinate and disrespectful". Fisher makes that claim again and has more proof of the same.
Furthermore Buckley's emphasis should have been on apologizing for spreading misleading information that Fisher left work 1 hour and 45 minutes early, when he actually worked almost 2 extra hours on his own time & he came in at 8:37 till 10:14 (97 minutes) on Sunday Nov 22/98 on his own time to polish the new wax to harden it so that it would last longer. Certainly proof Fisher was NOT stealing time from SD #23 as
Buckley maliciously claims.
Fisher Apr 9/99 letter to Akehurst, "Buckley and Stutter (Head Custodian) authorized me to leave early on Oct 15/98 when you claim that I left 82 minutes early. Buckley asked me to work the 7:00 AM- 5:00 PM split shift Oct 16/98. If I worked until 11PM on the 15th, got to bed by 12:30 and up at 5:30 in order to be at work for 7AM I would only get 5 hours of sleep". "Buckley agreed to me leaving early but told me to forget about working extra time on the 16th.", So here we have Buckley instructing me to cheat SD #23 out of 82 minutes."
Buckley wrote in the border of a copy of Fisher's Apr 9/99 letter, "I remember the incident this would have been one of the few times I noted that I gave authorization to leave early I do not recall the date." Buckley's Feb 25/99 letter Lownsbrough signed, claimed that Fisher had left early without authorization. Here is proof that Buckley's time theft accusation was false and her version was distorted and Fisher's was more accurate. Further Buckley writes that, "The report shows the school was closed at 9:59 on Fri Oct 16/98 by relief (custodian) #6." Buckley is incorrect again writing to Akehurst, as the alarm printout supplied to Fisher by SD #23, of which Buckley had a copy, shows that the school was closed at 9:00pm (21:00) not 9:59pm (21:59) as Buckley incorrectly claimed. An on call custodian worked the
5-9pm shift. Fisher worked the 7am-6pm. Buckley accused Fisher of closing the school at 9:59pm & leaving early. Buckley was maliciously attacking Fisher & stacking the deck against him.
Fisher Apr 9/99 letter to Akehurst, "I reject your statement that I was unable to work co-operatively with supervisors."
Buckley wrote in the border of a copy of Fisher's Apr 9/99 letter, "Ken was objecting to having to be available to allow a teacher back in that evening & was saying he could not be expected to be at a certain place at a certain time."
Buckley is being is twisting the truth. Fisher explained at the time that he never knew where he was going to be at any one time and offered his personal cell phone number so the teacher could call him and make arrangements for a time and place as he had gladly done with other teachers in that school. Fisher was even willing to pay the cell phone cost. The teacher was uncertain as to the exact time she would be coming back.
Again Buckley version is purposely distorted, victimizes Fisher and misleads Akehurst. SD #23 forced Fisher to clean 2500 sq. feet over regulations at a frantic pace to complete 9 hours of work in 8 hours. Buckley failed to reduce the area that she knew was oversize. Buckley's version is dishonest.
Fisher Apr 9/99 letter to Akehurst, "Even after Ainsworth and Stutter rearranged my sweep it was still 1000 square feet over the 18,200 Johnson stated in her NOV 6/98 letter to Buckley for an 8 hour shift,"
Buckley again is distorting the accurate facts and misleading Akehurst when in
the border of a copy of Fisher's Apr 9/99 letter Buckley wrote to Akehurst, "This figure (18,200) was given to Johnson by Fisher." Refer to Johnson's Nov 6/98 letter on page #5 in which Johnson states, "The (SD #23) formula for Elementary Schools is currently based on 18,200 square feet per 8 hour shift. Contrary to Buckley, Fisher did not give the 18,200 to Johnson, Fisher got the 18,200 from Johnson's letter. Remember Fisher's statement at the Nov 19/98 meeting when he thought that his version of events were more accurate than Buckley's. Now you know how Fisher arrived at that conclusion that Buckley distorts the facts & often is completely out of touch with reality...psychotic and how correct he was in making that assessment.
Buckley is not a source for accuracy, as she continuously twists the truth to suit her needs. An extremely unreliable & untrustworthy supervisor.
Principal Buckley had just transferred from a tiny 180 student school that she had been at for 8 years to the Westbank Elementary of approximately 480 students. There were signs early on that Buckley was overwhelmed by the magnitude of the new position and that she did not have sufficient training to be a custodian supervisor, evidenced by these examples. Buckley created an acid , stressful and harassing atmosphere in which Fisher had to work.
Akehurst Apr 23/99 letter, "These records reveal both a dedication to additional work as you have pointed out as on three occasions you have worked more than an additional half hour on your shift and that you worked almost two hours on a Sunday all without claiming overtime. Compare this Akehurst statement with Buckley's many distortions.

No it wouldn't even dawn on egotistical Buckley to offer any remorse for the damage her incompetence & dishonesty inflicted on Fisher.

At a time when there is concern about schoolyard bullying, Buckley, Lalonde & Stutter got away with workplace bullying Custodian Fisher
Buckley, Lalonde & Stutter took part in workplace bullying that
became their pattern of conduct, creating a toxic workplace.
1. Spreading malicious rumors about the victim in School District #23 documents.
2. Withholding necessary job evaluation information from the victim.
3. Constantly changing expectations applicable to the victim.
4. Blocking the victim's leave for promotion to regular employee status.
5. Assigning unreasonable duties to the victim already working an oversize area.
6. Constantly & persistently criticizing the victim's work.
7. Making false accusations about the victim knowing them to be wrong.
SCHOOL DISTRICT #23 MALFEASANCE
Following are examples of what experts refer to as psychological violence in the workplace that takes the form of bullying, intimidation & harassment.
Principal Buckley used distortion to have 52 days added to Fisher's probation period.
Principal Buckley often shortened Custodian Fisher's shift, then assigned extra work.
Vice Principal Lalonde told lies about Fisher to SD #23 administration.
Head Custodian Stutter constantly unjustifiably criticized Fisher.
Head Custodian Stutter constantly threatened Fisher with a bad report.
Head Custodian Stutter told lies about Fisher to Principal Buckley.
Head Custodian Stutter lied about ordering desperately needed supplies & equipment.
SD 23 was “malicious, high-handed, outrageous, reckless, wanton, entirely without
care, intentional, deliberate, callous, disgraceful, willful, exploitative, and in disregard
of Custodian Fisher's rights and indifferent to the consequences.”
